New Ruling Allows Smoking on Patios and Rooftops of Bars and Restaurants

A new ruling from the Michigan Department of Agriculture will allow patrons of bars and restaurants to again smoke on outdoor patios and rooftops in certain circumstances.

According to a new interpretation of the smoke-free law that has been in effect since 2010, smokers will now be able to light up on rooftops and patios of bars and restaurants as long as no food or beverages are being served.

MLive said Department of Agriculture Director Jaime Clover Adams announced the decision on Monday which will go into effect immediately. She said the decision is just a "minor change" and makes "things clearer for people about when smoking is prohibited."

Michigan's smoke-free law prohibits smoking at all restaurants, bars and businesses including hotels and motels. Casinos are excluded from the law.
