Looks like some legal action is on the way. This is an update from a previous story.

What started as a typical afternoon at the daycare turned into a near tragic nightmare for two loving parents. Little 2-year-old Kolten Ghinelli walked out the front door of the Always Learning Daycare in Burton, wandering all the way to a very busy Belsay Road.

Just in the knick of time he was saved by Terrence Roshell, who jumped out of his car scooping Kolten up before he ran out into traffic. Police said Kolten's parents didn't learn about the incident until several hours later because the daycare director lied to the police.

 False information on how to contact the parents was provided, in fact the parent's weren't even contacted in the first place.As a result the 23-year-old daycare director will be facing a charge of providing false information to police.
Since that day, the state launched an investigation into the daycare and found they were in violation on three counts, forcing the owner to hand over the license and close the doors for good. More in the video.
