
Michigan Woman Sues Monster Energy Over Dead Mouse in Can
A Grand Rapids woman has filed a lawsuit against the makers of Monster Energy drinks, claiming she found a dead mouse at the bottom of her can.
McKenzie Cain purchased the beverage at a Big Apple Bagels store in Grand Rapids in April 2024. After finishing the drink, she noticed the can still felt unusually heavy. According to The Detroit News, she opened it out of curiosity—and made a shocking discovery.
The lawsuit alleges that Cain found a dead mouse lying at the bottom of the can.
Cain filed the lawsuit in state court last September, but on Monday (July 14), the case was transferred to federal court in the Western District of Michigan.
What the Lawsuit Alleges
The lawsuit filed by McKenzie Cain claims that Monster Beverage Corp. violated the implied warranty of merchantability, a legal standard under the Uniform Commercial Code. This warranty assumes that a product sold by a merchant is fit for its intended purpose and safe for consumption, unless otherwise stated.
Cain says this warranty was breached when she allegedly discovered a dead mouse at the bottom of her Monster Energy drink.
As a result, the suit alleges Cain suffered:
- Severe emotional distress
- Psychological trauma
- Physical illness
Cain is seeking at least $25,000 in damages, plus interest, court costs, and attorney fees.
Cain’s lawyer, Zachary T. Runyan, says discovering a mouse in a beverage is both disgusting and dangerous.
“Mice, like all rodents, often carry diseases that can be extremely harmful. It goes without saying that no beverages should ever make it to the shelf with a dead animal inside it,” he said in a statement.
