Today, my newsfeed is packed with awesome back-to-school photos. I love those side-by-side comparisons, whether it is the first day of kindergarten next to the first day of 9th grade, 12th grade, or even college.

But it raises a question: Why are so many Michigan students heading back to school before Labor Day, even though state law says they shouldn’t?

(And while those photos are fun, a quick reminder: be careful not to overshare. Experts recommend leaving out details like your student’s school, teacher’s name, or grade, and double-check that your address is not visible in the background. What the Law Actually Says

Back in 2005, Michigan lawmakers passed a law requiring public schools to start after Labor Day. The goal was to give families one last long weekend together and protect Michigan’s tourism industry during the peak summer season.

Over time, though, more districts have applied for waivers to start earlier. Schools argue that beginning in August allows them to wrap up the first semester before winter break, gain extra instructional time before state testing, and better match up with college calendars.

How Many Districts Start Before Labor Day

As of 2025, Michigan has about 553 school districts plus 57 Intermediate School Districts (ISDs). Of those, 49 out of 56 ISDs have waivers permitting early starts. That adds up to roughly 75 percent of Michigan schools beginning before Labor Day, even though the law still says otherwise.

So while the statute remains, the reality is that most Michigan kids are already back in class by late August.
