The Campbell’s Soup Company has filed a lawsuit against Detroit-area congressional hopeful Shelby Nicole Campbell and her campaign committee, accusing them of infringing on Campbell’s trademarks.

What Campbell’s Is Seeking

According to the complaint filed in the U.S. District Court for the Eastern District of Michigan, Campbell’s argues that the candidate’s use of the slogan “Soup4Change” and the branding of her campaign with red-and-white soup can imagery falsely suggests an affiliation with, or endorsement by, the company.

What Campbell’s Is Seeking

  • An injunction barring further use of the contested designs, logos, hashtags, or other materials that evoke Campbell’s trade dress.
  • A jury trial on claims including trademark infringement, false designation of origin, and false endorsement.

According to CBS Detroit, the food company claims to have received numerous emails and inquiries about its endorsement of the candidate. The suit indicates that a cease-and-desist letter was sent to Campbell on September 2 and was subsequently ignored.

As of this writing, all red-and-white soup can imagery and references have been removed from the candidate’s website. However, the web address soup4change still directs to the Campbell for Congress website.

Candadate Shelby Campbell's Response to Lawsuit

Shelby Campbell tells CBS Detroit that she is unable to discuss the specifics of the lawsuit, noting:

"Powerful institutions, whether educational or corporate, often use their vast resources to control narratives, intimidate individuals, and dictate outcomes. This is exactly why I'm running for Congress: because our legal system should not be a weapon reserved for the wealthy."
