Judge Blocks Michigan’s Ban on E-Cigarettes — But for How Long? [VIDEO]

Michigan's two-week ban on flavored e-cigarettes has been lifted, but the future of vaping products is still very much up in the air.

A preliminary injunction was issued Tuesday (10/15) by Court of Claims Judge Cynthia Stephens. Stephens says Gov. Gretchen Whitmer's administrator's delay implementing the ban undercut its position that emergency rules were needed.

WXYZ spoke with Marc Sils, the owner of 906 Vapor in Houghton. He has filed a lawsuit, claiming the ban on e-cigarettes is illegal. He notes that approximately 80% of his store's inventory would be deemed illegal under the ban and that would force him to close his store.

His lawsuit contends that officials have circumvented the regular rule-making process.

In order to overturn the ban, Gov. Whitmer would need to go to the state's Supreme Court, which she says she intends to do.

Vaping has been linked to 26 deaths nationwide including one in Michigan. It's unclear if those deaths have been caused by legal vaping supplies or black market vaping pens that don't meet FDA standards.
